El Consejo de Europa, a través de la sesión del Comité de Ministros, el 20 de enero de 2010, en la 1075 reunión de los delegados de los ministros, adopta la recomendación CM/R (2010)1, sobre las reglas de probation. La probation es una figura legal no existente como tal en la legislación española que incluye aquellas actividades e intervenciones que implican una supervisión y asistencia en la comunidad (fuera de los centros penitenciarios), incluyendo la libertad condicional, libertad vigilada, el asesoramiento y la mediación. El propósito del Consejo de Europa es conseguir una mayor unidad entre sus miembros, en particular mediante una aproximación de las legislaciones en asuntos de interés común y considerando que el objetivo de la probation es contribuir a un proceso de justicia criminal justo, así como a la seguridad pública, evitando y reduciendo la comisión de delitos. Se hacen estas recomendaciones considerando que los organismos de probation se encuentran entre los principales organismos de justicia y que su labor tiene gran impacto sobre la reducción de la población penitenciaria.
