Comentario a las normas penitenciarias europeas

Las normas penitenciarias reflejan el compromiso de tratar a los reclusos de forma justa y equitativa. El primer intento de establecer estas reglas en Europa se produjo en 1973, introduciendo las reglas mínimas europeas para el trato de los reclusos, mediante la resolución (73)5 del Consejo de Europa. Estas reglas pretendían adaptar a las condiciones europeas las reglas mínimas de Naciones Unidas para el trato de los reclusos, que ya fueron formuladas en 1955. En 1987 las normas penitenciarias europeas fueron revisadas a conciencia a fin de que pudieran, como expresa la exposición de motivos, “recoger las necesidades y aspiraciones de las administraciones penitenciarias, de los reclusos y del personal de prisiones en un enfoque coherente de la gestión y el trato que sea positivo, realista y contemporáneo”. La actual revisión tiene el mismo objetivo general. Como sus predecesoras, se fundamenta tanto en las reglas penitenciarias previas como en los valores del Convenio Europeo para la Protección de los Derechos Humanos. Sin embargo, desde 1987, se han producido muchos desarrollos en el derecho y la práctica penitenciarios en Europa. Los cambios evolutivos en la sociedad, la política penal, la práctica y la investigación de las sentencias, junto con la adhesión al Consejo de Europa de nuevos Estados miembros, han cambiado significativamente el contexto de la gestión penitenciaria y el trato de los reclusos.
